Monument care: Duties and their violation in our law Abstract The Czech Republic is a area where almost any small village is a home to a cultural monument. We indeed possess one of the richest cultural heritages in the world. However, it is important and necessary to protect them so that knowledge and experience can be drawn from them by future generations as well. Such protection is associated with a series of duties that various entities must fulfill. This master's thesis specifically deals with these duties. Its goal is to describe and evaluate the state of legal regulation of monument care in relation to these duties and their violations. The focus is primarily on owners of cultural monuments and other obligated entities who are authorized to conduct archaeological research or restore cultural monuments. Therefore, due to the current relevance of the entire topic, this work has been created. Moreover, it could, at least partly, serve as a form of enlightenment, even for the general public. To a large extent, it engages with the Act on State Monument Care, commentary literature, and case law. Simultaneously, problematic sections are illustrated through practical examples derived precisely from judicial decisions. Fulfilment of the public interest in monument preservation in the Czech republic

My thesis is concerned with current problems involving fulfilment of the public interest in monument preservation in the Czech Republic. Firstly, the term "public interest" and its conceptual relationship in terms of the monument preservation is explored in the theoretical part of the thesis. Secondly, the current systems of monument preservation in the Czech Republic including the genesis of decision-making processes of municipal authorities under the current law are briefly described. This is followed by an explanation of the connection between the generally proclaimed, yet critically unexplored postulate of "two-track monument preservation". Despite clearly defined policies and competencies, the existing monument preservation decision-making systems and processes seems to be characterized by considerable confusion, and thus seem to bring about some process-based ambiguities and conflicts. The thesis not only aims to identify and analyse these ambiguities and conflicts but also strives to provide a conclusion that proposes some meaningful solutions. Protection of immovable cultural monuments Abstract There have been preserved many cultural monuments in the Czech Republic to the present day, and this thesis named "Protection of immovable cultural monuments" deals with their legal protection. The aim of this thesis is to describe and evaluate current legislation on this topic, and afterwards point out problematic areas and legislative gaps. The thesis works mainly with Act on State Monument Care, its commentary literature and case law related to it. The thesis is composed of an introduction, five parts and a conclusion. The first part of the thesis introduces the topic by describing historical development of monument care. It begins from the oldest medieval period and continues over Habsburg Empire after 1848 until the 1950s when a first law on monument care was enacted in the Czech territory. The folowing part focuses on sources of law. A new Act on State Monument Care, which has been being prepared for a long period of time, was briefly mentioned here too. The third part explains organizational structure of state monument care in the Czech Republic. The next part is about protected objects and territories. The building Act and the protection of archeological heritage

The aim of diploma thesis titled The Building Act and the protection of archeological heritage is the introduction of preservation of archeological sites related to contemporary building boom. Sources of law devoted to this topic are primarily the Building Act which regulates town and country planning as the instrument of preventive protection of archeological heritage and secondly the Preservation of Monuments Act that enshrines rights and duties of builders concerning to their activities due to the protection of archeological sites.
